How to arrange a divorce?

No matter how beautiful the wedding is, how deeply in love two people are with each other and how many kids they have, a divorce can sometimes be inevitable between two individuals. If you and your partner wish to end the marriage and be legally separated, there will be a number of arrangements that have to be made in order for the process to be fully through with.

A settlement is a document in where you and your partner set out the agreements you and your partner make regarding your joint pension, children and other matters.

Once both parties are satisfied with the settlement, there are three ways for partners to separate legally. These are divorce, legal separation (both are still married but do not reside under one roof) and dissolution of the marriage after legal separation.

The next step is to register your divorce with the municipality in which you had your marriage. The court will issue a divorce decree and you will have to finalize it by having it recorded in the registry of births, deaths, marriages and registered partnerships. If you wish to save yourself from the legal hassle of doing everything yourself, it is best to have lawyers do most of the work for you especially the calculation of divorce proceedings. If there is a child in question, multiple issues would have to be agreed on either in front of a court or in the settlement. Issues such as child support, types of child custody, visitation, health insurance, college education, residence in the marital homestead, beneficiaries of life insurance policies, claiming children as dependents for income tax, and the religious upbringing of children. Depending on how a couple would want to go about the divorce these matters can either be discussed in a settlement drafted by a family law attorney or in court.

Whatever the case may be, it is best and smoothest to go with a seasoned divorced attorney to handle your separation. A good attorney will guide you through the whole process and will save you a lot of time and money in the long run. Maintaining a good relationship with your soon-to-be ex is also a great idea as it will make settlements run more smoothly compared to an ill one. Try to avoid fights about the topics of discussion and discuss with your lawyer your intentions with the properties at the very beginning of the divorce settlement. This will ensure that things will run the smoothest and will save a lot of time and worry.
